General terms of Sales
Article 1: Purpose
Hereby are defined the services of nautical training on board the boat called «Quintessence» which belong to Mr. David GIRARDO and the nautical trainings on board some boats that do not belong to Mr. David GIRARDO.
Article 2: Description
The service will take place at the agreed dates between the two parties according to the following course :
2a – “Discovery” service:

How the service will take place: introduction and discovery to sailing of the cruising type. Meals are not included. Are included in the package: disposal of the boat and of the supervision, civil liability insurance and the passengers’ individual insurance, the individual security material, refreshments on board.

Packs of lessons are valid for one year from the date of the first lesson.

The disposal of the supervision is included in the package. At any time of the service the customer remains the captain of the boat which is used and as such the customer remains the only one responsible for the possible damages which could happen during the service. During the whole course of the service, he or she keeps all authority on board. An insurance certificate of the boat may be required.
- Collectives sessions :
Group lessons are held from September 15 to June 15, every 1st and 3rd Saturday afternoon of each month (approximately 15 sessions). Dates can beoffset if the schedule permits in case of bad weather, for technical reasons or absence of the monitor.
Rates:
- Registration for the full season: 700 € / person
- Register for one session: 70 € / person

One lesson lasts for approximately 2 hours.
The package called “port manoeuvres” is valid for one person and includes 2 practical lessons and one theoretical lesson of approximately 2 hours.
2d – “Training” service
- embedded training :
The service lasts several days while cruise sailing, accessible to all practice levels. 5 persons maximum on board.

Collective training sessions are 5 ½ consecutive days from Monday to Friday. The courses are collective and allow an approach to navigation with a crew. Booking essential

2e – Service called “cruise assistance”
The cruise assistance is supposed to help while sailing and it is provided by an instructor or a skipper during a private cruise. The instructor or the skipper embark on board the boat that is used by the customer in order to bring him some support and some technical advice. During the whole service period, the customer remains the decision-making skipper and remains consequently the whole person responsible of all the incidents which may happen during the period.
The customer will have to be able to present his or her insurance certificate that covers the navigation risks (boat and crew) during this period and testifies that the state and equipment of the boat are in accordance with the legislation in force.
During the whole service period the instructor or the skipper on board is taken charge of by the customer (food and accommodation) and he is not required to participate in the cashbox on board in any case.
The skipper or the instructor commits himself to be available at all times during the service period and to take part in the collective tasks on board.
Price: 250€ / day
Article 3: Booking
The booking should be done either by telephone, by post or by e-mail sent to the address This email address is being protected from spambots. You need JavaScript enabled to view it. with the payment of an instalment of 30% of the total service price for the group bookings, and the payment of the total amount for the individual services. The date, the type of the chosen service, the amount of participants and their identity must be precised. The service provider David GIRARDO commits himself to give information about the service availability within 48 hours.
Article 4: The customer’s duties
On the one hand, the customer commits himself or herself to respect the dates and times agreed upon during the sell. On the other hand each participant testifies to be able to swim or at least to be able to be immersed into the water entirely while being equipped of a life jacket and to propel him or herself over a short distance. Minors must produce a parental consent.
Article 5: Cancellation costs
The service provider keeps for himself the right to shorten, to cancel or to postpone the service if the weather conditions seem inadequate to him for the outing. In case of a cancellation or if the activity cannot take place and cannot be postponed because of technical reasons, the payment of the service shall be reimbursed without other compensation.
In case of a cancellation required by the customer:
- More than 30 days in advance: no costs
- Between 30 days and 7 days before the date: invoicing of 30% of the service price
- Less than 7 days before the date: invoicing of the whole service.
Article 6: Guarantees
The service provider commits himself to provide some coherent training, to take care of his participants’ well-being and security according to the rules in force (particularly the modified Law of the 16/07/1984 and Decree of the 9th. February 1998). In order to do so he commits himself to provide and to maintain the boat called «Quintessence» in a navigation state, to insure it with civil and individual Liability for the transported persons. He recognizes being fully able to exercise such an activity and to be the owner of a State Certificate of Sport Instructor in sailing.
Article 7: Responsibility
On board the boat called «Quintessence», the service provider remains the only person responsible of the course development and he will be able to take all the dispositions necessary to guarantee the security of the boat and of the participants.
On board a boat which does not belong to David GIRARDO, the customer remains at any time of the service the captain of the used boat and as such he or she stays the only person responsible for the possible damages which could take place during the service. During the whole service progress, he or she keeps all authority on board in order to take the measures that he or she judges necessary in order to guarantee the security of the boat and of the participants.
Article 8: Payment
The payment of invoices will be done by voucher or presentation box, by banker’s cheque, cash or bank transfer to the service provider’s bank account at the latest on the day of the service.
Article 9: Jurisdiction:
The general terms are submitted to the French law. Any lawsuit connected with their interpretation, their execution or their breaking off will fall within the competence of the repeal courts of law in Aix-en-Provence.
